SunTax Pro – Terms of Use

Welcome to SunTax Pro. These Terms of Use (“Terms”) govern your access to and use of the SunTax Pro Professional Tax Software, related websites, mobile applications, and support services (collectively, the “Services”).

By accessing or using SunTax Pro, you agree to these Terms. If you do not agree, do not use the Services.

1. Acceptance of Terms

By creating an account, logging in, or using SunTax Pro in any way, you acknowledge that you:

-Are at least 18 years of age;

-Are authorized to act on behalf of your business or entity (if applicable);

-Have read, understood, and agree to comply with these Terms and all applicable laws.

2. License to Use Software

SunTax Pro grants you a non-exclusive, non-transferable, limited license to use the software for the purpose of preparing, filing, and managing tax returns for your clients or business.

You may not:

-Copy, modify, or distribute the software or its content;

-Reverse-engineer or attempt to access the software’s source code;

-Use the software for any unlawful or unauthorized purpose.

3. User Accounts

You are responsible for maintaining the confidentiality of your username, password, and account access.

You agree to:

-Provide accurate information during registration;

-Immediately notify SunTax Pro if you suspect unauthorized use of your account;

-Be solely responsible for all activity under your account.

4. Permitted Use

The SunTax Pro software is intended solely for professional tax preparation and related business use.

You agree not to:

-Misuse the platform to file fraudulent returns or obtain unauthorized refunds;

-Share or sell access to the software or its data;

-Use the software in a way that violates IRS regulations or state laws.

5. Fees and Payments

Access to SunTax Pro and related programs may require the purchase of a license, subscription, or service fee. All payments are due as specified in your agreement or purchase confirmation.

Unless otherwise stated, all fees are non-refundable. Failure to make timely payment may result in suspension or termination of your account.

6. Data Ownership & Privacy

You retain ownership of your client and business data.
By using SunTax Pro, you grant us permission to process, store, and back up your data in accordance with our Privacy Policy. We take reasonable measures to protect your information but cannot guarantee absolute security against all potential threats.

7. Compliance and EFIN Use

If you operate as an Electronic Return Originator (ERO) or tax preparer, you agree to maintain a valid EFIN, comply with all IRS rules, and follow all applicable data security and due diligence requirements. SunTax Pro reserves the right to verify your credentials or suspend access if your compliance status is in question.

8. Third-Party Services

The software may integrate with third-party partners (e.g., banks, refund transfer providers, marketing platforms). SunTax Pro is not responsible for the actions, content, or policies of third-party providers. Your use of third-party services is at your own discretion and subject to their own terms.

9. Intellectual Property

All trademarks, logos, graphics, user interfaces, and software code are the property of SunTax Pro, LLC or its licensors. No rights are transferred to you except for the limited license explicitly stated in these Terms.

10. Termination of Access

SunTax Pro may suspend or terminate your access to the software at any time, without prior notice, if:

-You violate these Terms or applicable laws;

-You engage in fraudulent or abusive activity; or

-Payment for your account becomes delinquent.

-Upon termination, all licenses granted under these Terms will immediately end.

11. Disclaimer of Warranties

The Services are provided “as is” and “as available” without any warranty of any kind, express or implied. SunTax Pro does not guarantee uninterrupted access, error-free performance, or specific results from using the software.

12. Limitation of Liability

To the fullest extent permitted by law, SunTax Pro and its affiliates are not liable for any indirect, incidental, or consequential damages resulting from:

-Loss of profits or data;

-Delays, errors, or interruptions in service; or

-Unauthorized access to your account or data.

13. Updates and Modifications

SunTax Pro may update or modify these Terms, the software, or pricing at any time.
Continued use of the Services after changes are posted constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Arapahoe County, Colorado.
